Landmark Amendment Empowers Female Government Servants: CCS (Pension) Rules Altered to Prioritize Child Nomination for Family Pension

In a transformative move reflecting the commitment to women empowerment, the Department of Pension & Pensioners’ Welfare has amended the Central Civil Services (Pension) Rules, 2021. The revised rules now allow female Government servants and pensioners to nominate their eligible child or children for family pension, superseding their spouse. This progressive change, effective from January 1, 2024, aims to address concerns arising from marital discord and legal proceedings.

Under the previous provisions, family pension was initially granted to the spouse, with other family members becoming eligible only after the spouse’s ineligibility or demise. Recognizing the need for flexibility, the Department of Pension & Pensioners’ Welfare responded to numerous queries from Ministries/Departments regarding the nomination of children by female Government servants or pensioners when facing divorce or legal proceedings.

The amendment facilitates a streamlined process for female Government servants or pensioners by allowing them to request the grant of family pension to their eligible child or children in situations involving divorce proceedings, cases under the Protection of Women from Domestic Violence Act, Dowry Prohibition Act, or the Indian Penal Code.

In case of pending divorce proceedings, the female Government servant or pensioner may submit a written request to the Head of Office. If the female Government servant or pensioner passes away during the ongoing legal proceedings, the family pension will be disbursed prioritizing the eligible child or children over the spouse.

The amendment outlines a structured approach for family pension distribution based on various scenarios, ensuring financial support to widowers, minor children, and those with disorders or disabilities. This inclusive revision is a significant step towards empowering women employees and pensioners, aligning with the government’s commitment to gender equality and social justice.
